Minerals and Mining Development Board
The Minerals and Mining Development Board was established in terms of section 57 of the
Mineral and Petroleum Resources Development Act 2002, Act 28 of 2002. It was formally launched in June 2005.
The board advises the Minister of Minerals and Energy on:
- Any matter that must be referred to the Board by or under the Act;
- The sustainable development of South Africa's mineral resources;
- The transformation and downscaling of the minerals and mining industry;
- Dispute resolution; and
- The promotion of human resources development in the mining industry.
The board is made up of stakeholders from industry, government and organised labour. Representation of the board is legislated under section 59 of the Act and is as follows:
- Department of Minerals and Energy;
- Department of Trade and Industry;
- Department of Environmental Affairs and Tourism;
- Organised labour;
- Organised business;
- Community-based organisations;
- Non-governmental organisations; and
- Independent specialists.
Board sub-committees
Regional Mining Development and Environmental Committee
The Regional Mining Development and Environmental Committee (RMDEC) was established in terms of section 64(1) of the MPRDA in all nine regional offices of the Department of Minerals and Energy. The Committee comprises not more than 14 members drawn from the relevant government departments or organs of State at national, provincial and local levels.
The functions of the committee include:
- The promotion of co-operative governance as contemplated in terms of section 41 of the Constitution;
- Handle objections regarding any application in terms of the MPRDA;
- To advise the minister, the regional manager, the designated agency and the board with regard to any matter referred to it in terms of the MPRD Act; and
- Deal with conflict regarding compensation between the holder of the right and the landowner and make recommendations to the regional manager.
Sector Partnership Committee
The Sector Partnership Committee (SPC) has been adopted as one of the committees of the board in terms of section 64(2) of the Act. It was initially established as a tripartite promotional body to implement promotional and mineral development strategies. It involves the relevant stakeholders from the government, business and labour.
It is chaired by a nominated board member. The main function of the SPC is to co-ordinate the activities of its three working committees as directed by the board and report their progress to the board.
The sub-committees of the SPC are as mentioned below and consists of members nominated by relevant government departments, organised business and organised labour.
Transformation Committee
The functions of the transformation committee are:
- Transformation and downscaling issues;
- Promotion of human resources development in the industry in consultation with the Mining Qualifications Authority (MQA);
- Ensuring that the industry participates in rural and economic development activities.
Beneficiation Committee
This committee looks at the sustainable development of South Africa's mineral resources and at furthering job potential through developing the minerals industry throughout the value chain.
Industry Promotion Committee
This committee is responsible for enhancing the image of the industry and attracting investment through publicity and information to maximise the growth and job-creation potential of the industry.
