Mine surveying and legislation
Mine Surveying is regulated by the Mine Health and Safety Act 1996, No 29 of 1996.

- Definition of a competent person in charge of mine surveying, mapping and mine plans: Chapter 17 of the Mine Health and Safety Act, Act 29 of 1996: Regulations
The alternate definitions referring to levels 6 and 5 "registered on the National Qualifications Framework" as stipulated in regulations 17(1)(a), 17(1)(b)(ii) and 17(1)(c)(iii) are hereby withdrawn until the re-convened Survey TTG make recommendations to Mining Regulatory Advisory Committee (MRAC) on the appropriateness of the MQA qualification levels in this regard.

- Certification of the mine ventilation and rescue plan: Chapter 17 of the Mine Health and Safety Act, Act 29 of 1996: Regulations
The Mine Ventilation and Rescue Plan referred to in regulation 17(19) must be signed by the responsible person referred to in regulation 17(2) to certify the accurate representation of the workings on the plan as well as by the competent person engaged by the employer in terms of section 12(1) of the Act, to certify the accurate positions of the stipulated ventilation items which are shown conventional on the plan.

- Appointments of competent persons in charge of mine surveying, mapping and mine plans: Chapter 17 of the Mine Health and Safety Act, Act 29 of 1996: Regulations
Regulations 2.12.1 and 2.12.2 in force in terms of Section 4 of the Act, are in contradiction with regulation 17(2) and are hereby withdrawn until the re-convened Survey TTG make recommendations to MRAC regarding competency levels on appointments.

- Appointments of competent persons in charge of mine surveying, mapping and
mine plans at two or more mines: the Mine Health and Safety Act, Act 29 of
1996: Regulations under Chapter 17. Since Regulations 2.12.1 and 2.12.2 in
force in terms of Schedule 4 of the Act were withdrawn in accordance with
instruction S – 3/2006 dated 15 February 2006, additional appointments
under Regulation 2.12.6 must now be made under Regulation 17 (2). In view
hereof, Regulation 2.12.6 is hereby withdrawn until the reconvened TTG make
recommendations to MRAC in this regard.
All pending and future applications for appointments of responsible
persons to be in charge of mine surveying, mapping and mine plans on two or
more mines must be referred to the Director: Mine Surveying for his
